OFFICIAL RULES

1. NO PURCHASE NECESSARY TO ENTER OR WIN. SWEEPSTAKES OPEN TO RESIDENTS OF THE 50 UNITED STATES AND DISTRICT OF COLUMBIA WHO ARE 18 YEARS OF AGE OR OLDER AS OF 4/15/08. TWO WAYS TO ENTER: 1) Beginning 12:00:01 a.m. Eastern Standard Time ("EST") on 4/15/08 through 11:59:59 p.m. EST on 9/1/08, you may enter online at www.hickoryfarms.com by completing all required fields of the entry form OR 2) You may also enter by completing the Official Entry Form found on tear-pads at participating retail locations while supplies last, or on a 3x5 card by providing your complete name, street address (no P.O. Boxes), city, state, zip code, email address (optional), telephone number, and birth date, and mailing in a first-class stamped envelope to: "Win the Backyard of Your Dreams" Sweepstakes, PO Box 4111, Grand Rapids MN 55730-4111. Limit one (1) entry per household or address, regardless of method of entry. All mail-in entries must be postmarked by 9/1/08 and received by 9/10/08. No mechanical reproductions, copies, facsimiles, or reproductions of entries accepted. Hickory Farms (the "Sponsor") is not responsible for lost, late, stolen, incomplete, illegible, misdirected or postage-due entries or faulty machinery or other mechanical error. All entries become the exclusive property of the Sponsor and will not be returned or acknowledged. By entering, entrants accept and agree to be bound by the Official Rules and decisions of the judges, which are final and binding. Sweepstakes begins 12:00:01 a.m. EST on 4/15/08 and ends on 11:59:59 p.m. EST on 9/1/08.

2. PRIZES: One (1) Grand Prize winner will receive the "Backyard of Your Dreams" prize package including two (2) outdoor speakers, one (1) outdoor television, outdoor lighting set, outdoor grill, outdoor fire pit, & a patio furniture set -. Exact prize components are at Sponsor's discretion. Grand Prize winner will also receive an American Express gift card in the amount of $500 for installation purposes. Any costs beyond this amount are not covered by Sponsor. ARV: $12,500.00. Fifty (50) First Prize winners each will receive a Hickory Farms Gift Basket - ARV: $100.00 each. Odds of winning any prize depend on the total number of eligible entries received. Total ARV of all prizes is $17,500. Prizes consist of only those items specifically listed as a part of each prize. If actual value turns out to be less than stated ARV, the difference will not be awarded.

3. DRAWING: Potential winners will be selected in a random drawing on or about 9/15/08 from among all eligible entries received. Decisions of judges are final in all matters relating to this Sweepstakes. Potential winners will be notified by telephone or mail on or about 9/15/08. Please allow 4 to 6 weeks for delivery of Grand Prize. Please allow 4 to 6 weeks from date of drawing for delivery of First Prize.

4. REQUIREMENTS OF POTENTIAL WINNERS: For all potential winners: Each potential Sweepstakes winner will be notified by telephone, certified mail or overnight courier service. Except where prohibited by law, potential Grand Prize winner will be required to complete and return an affidavit of eligibility and liability/publicity release (the "Affidavit/Release") to Sponsor within seven (7) days of first being notified. If the potential winner does not respond to Sponsor within seven (7) days after the first attempt to contact him/her, if he/she fails to sign and return the Affidavit/Release within the required time period, or if he/she is otherwise ineligible to receive the prize, an alternate potential winner will be selected in his/her place in a random drawing of all entries received. In selecting an alternate, Sponsor or its promotion agency, in their sole discretion, may adjust the above timing and delivery requirements to accommodate the Sweepstakes schedule.

5. ELIGIBILITY: Sweepstakes open to legal residents of the 50 United States and District of Columbia who are 18 years of age and older as of 4/15/08. Employees of Sponsor and each of their respective affiliates, subsidiaries, advertising and promotion agencies, persons living in the same household and the immediate families of each are not eligible. Void where prohibited by law. All federal, state and local laws and regulations apply.

6. RELEASE OF LIABILITY: All entrants release Sponsor and each of their respective parents, affiliates, subsidiaries, officers, directors, agents, employees and all others associated with the development and execution of this Sweepstakes (collectively, "Released Parties"), from any and all liability with respect to, or in any way arising from, this Sweepstakes and/or acceptance or use of the prize, including liability for personal injury, death, damages or loss. Sponsor is not responsible for prize quality or utility. Entries generated by script, macro or other automated means will be void. Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or website, violates the Official Rules, or acts in an unsportsmanlike or disruptive manner, or with intent to annoy abuse, threaten or harass any other person. Released Parties are not responsible for technical, hardware or software malfunctions, telephone failures of any kind, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilized in this Sweepstakes which may limit the ability to participate or for any other error or problem of any kind, whether computer, technical, network, typographical, printing, seeding, human or otherwise, relating to or in connection with this Sweepstakes, including, without limitation, errors or problems which may occur in connection with the administration of the Sweepstakes, the processing of requests or entries, the announcement of the prizes or in any Sweepstakes-related materials. Sponsor reserves the right to modify, terminate, or suspend any portion of this Sweepstakes should virus, bugs, non-authorized human intervention or other causes corrupt the administration, security, fairness, or proper play of the Sweepstakes. In the event of termination of the online entry portion, a notice will be posted online indicating how to enter via the mail and, at Sponsor's discretion, any prizes may be awarded from among all eligible entries received for the drawing prior to termination and all eligible mail in entries received for the drawing.

7. PUBLICITY: Except where prohibited by law, participation in the Sweepstakes constitutes each entrant's and winner's consent to Sponsor's and its respective parents, subsidiaries and affiliates use of such person's name, biography, likeness, voice, photographs, video, opinions, hometown, state and country for promotional purposes in any manner or media (including, without limitation, online), worldwide, in perpetuity, and without further payment, consideration or consent.

8. DISPUTES: Except where prohibited by law, entrants agree that: (1) any and all disputes, claims, and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and solely and exclusively in a federal or state court located in Maumee, Ohio; entrant submits to sole and exclusive personal jurisdiction to said courts in the State of Ohio for any such dispute and irrevocably waives any and all rights to object to such jurisdiction; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental, consequential, direct or indirect damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant's rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Ohio, without giving effect to any choice of law or conflict of law rules (whether of the State of Ohio or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Ohio.
